Find a Tearoom Terms and Conditions

Terms used in these Terms and Conditions

"The Database" refers to the database of tearoom information and Authorized Client information (personal contact information).

"The Website" refers collectively to the website and its database.

"The Directory" refers to the database of Tearoom specific information only. No Authorized Client specific information is accessible from The Directory.

"Authorized Client" refers to a tearoom owner who has a tearoom listed in The Directory and for whom they are the legal business owner or appointed representative.

"Visitor" refers to a visitor to the website who uses the website to access The Directory.

(1) Use of Website

(a) By using and accessing this website you are agreeing to be bound by these Terms and Conditions of Use. If you do not agree with these Terms and Conditions, or do not wish to be bound by these Terms and Conditions, then do not use this website.

(b) Changes to these Terms and Conditions will be posted to this web page and no other notification will be given. Your use of this website constitutes an acceptance of these Terms and Conditions and any subsequent changes to these Terms and Conditions in force at the time of your use.

(2) Permitted Use

(a) Visitors are permitted to use The Website:

(i) to access information about Tearooms for their own personal use only. 

(ii) to contact Find a Tearoom using one of the approved methods detailed on The Website's Contact Us Page only. 

(iii) to apply to add a tearoom to The Directory for which they are the legal owner of the tearoom. Find a Tearoom reserves the right to refuse to add a tearoom submitted by The Visitor to The Directory without reason, explanation or right of appeal. Tearooms are added to The Directory entirely at Find a Tearoom's own discretion. 

(b) Visitors are prohibited from using The Website:

(i) to access personal information about Authorized Clients. 

(ii) for any purpose which does not comply with U.K. law (for accessing the website within the U.K.) or with the law in the jurisdiction from where the access is made. 

(iii) to access areas of The Website which The Visitor is not authorized to access. 

(iv) to update, delete or otherwise amend any part of The Website. 

(v) to obstruct the normal function of The Website or its availability. 

(c) Authorized Clients are permitted to use The Website:

(i) to view, add, modify or delete personal information about themselves or view, add, modify or delete information about the tearoom for which they are the legal owner or representative. 

(ii) to contact Find a Tearoom using one of the approved methods detailed on The Website's Contact Us Page only. 

(iii) To pay the annual fee (where applicable) for an Enhanced Listing or Enhanced Listing with a Web Page. Payments are processed by the third-party payment processor Pay Pal using their own secure web server. 

(d) Authorized Clients are prohibited from using The Website:

(i) to view, amend or delete Authorized Client information other that their own. 

(ii) for any purpose which does not comply with U.K. law (for accessing the website within the U.K.) or with the law in the jurisdiction from where the access is made. 

(iii) to access areas of The Website which The Authorized Client is not authorized to access. 

(iv) to update, delete or otherwise amend any part of The Website other than their own personal details or the details of any tearoom for which they are not the legal owner or representative. 

(v) to post any material deemed to be unacceptable including, but not limited to, material which is a pornographic, obscene, lascivious, indecent, filthy or of a lewd nature, material which provokes racial or religious hatred, material with the intent to abuse, threaten, annoy or harass any individual or group, material which infringes copyright or intellectual property rights or material contravening United Kingdom law.

(3) Submitting Data to The Directory

(a) Find a Tearoom endeavours to ensure the integrity and security of The Website. However all information supplied to The Website by Authorized Clients:

(i) is supplied entirely at the Authorized Client's own risk. 

(ii) must not contain material which is deemed unacceptable (see 2.d.v above). 

(iii) is accurate and up-to-date. 

(iv) does not contravene The Trade Descriptions Act 1968 

(v) conforms to the advertising codes laid down by the Advertising Standards Authority. 

(vi) is related entirely and exclusively to the Tearoom for which they are the legal owners or representatives. 

(4) Indemnity

(a) The Authorized Client:

(i) hereby agrees that Find a Tearoom shall be excluded from all liability for damage or loss caused by errors or inaccuracies in the information held in the database. 

(ii) hereby agrees the Find a Tearoom shall be excluded from all liability for loss of data, loss of business, loss of profits or other intangible loses resulting from The Website's use by The Authorized Client, website Visitors or by Find a Tearoom. 

(iii) hereby agrees that Find a Tearoom shall be excluded from all liability in respect of loss, damage or injury or any consequential or indirect loss sustained by The Authorized Client by reason of any act or negligence by the Authorized Client. 

(iv) shall be solely responsible for ensuring that information supplied to The Website do not infringe copyright, intellectual property rights and are not libelous. The Authorized Client will indemnify Find a Tearoom against any damage or loss resulting therein. 

(v) hereby agrees that Find a Tearoom shall not be liable for damage or loss of The Authorized Client's data supplied for the purpose of promoting the Authorized Client's tearoom whether the damage or loss results from negligence or caused otherwise. 

(5) Data Security

(a) Access to amend or delete Authorized Client data is protected via a Login Page for which a Client Number and Password is required. Authorized Clients are responsible for ensuring the secrecy of their Client Number and Password and are encouraged to change their password on The Website at least once a month. Find a Tearoom cannot be held responsible for illegal access to an Authorized Client's data resulting from a failure by the Authorized Client to secure their login details.

(b) With the exception of Passwords, data submitted by the Authorized Client directly to The Website is not encrypted when transmitted. Find a Tearoom cannot be held liable for any loss of information submitted to The Website. Authorized Clients must not submit data directly to The Website which they deem highly confidential.

(c) Online payments are made via third-party payment Processor, Pay Pal, and utilize Pay Pal's secure (encrypted) payment processes. Authorized Clients making payment via Pay Pal should read their Legal Agreement (external link). Find a Tearoom is not responsible for data protection on third-party websites.

(6) Copyright

(a) The Website and its content is the copyright of Find a Tearoom, including but not limited to website design, text, intellectual property, graphics (excluding stock images and Authorized Client uploaded images), database data, database design and source code.

(b) Copyright for Authorized Client uploaded images and text remains with the original copyright holder. Authorized Clients are reminded that it is their responsibility to ensure that they have the appropriate permissions to use any such submitted text and images on The Website and that they are solely liable for any breaches of copyright in these circumstances.

(7) Privacy

(a) Authorized Clients' personal contact details will not be disclosed to Visitors by The Website. An Authorized Client's personal contact details will be used solely for communication between Find a Tearoom and the Authorized Client. For more details please read our Privacy Statement.

(8) Severability

(a) Find a Tearoom reserves the right to remove a Tearoom from the Directory without reason, explanation or right of appeal. Tearooms are listed in The Directory entirely at Find a Tearoom's discretion.

(b) Authorized Clients can request that their personal details or details of their Tearoom be removed from The Directory by contacting Find a Tearoom using one of the approved methods detailed on The Website's Contact Us Page.

(9) Disclaimer

(a) Find a Tearoom is not responsible for the accuracy or content of the material which has been supplied by Authorized Clients and cannot be held liable for any damage or loss resulting from the use of the information contained within The Directory.

(b) Find a Tearoom shall in no event be held liable by an Authorized Client or Visitor or any third party for any damage or loss resulting from, but not limited to, the availability of The Website, telecommunication carriers, loss of sales, revenue, turnover, profits or indirect, consequential or special loss or User Agents, even if Find a Tearoom has been advised of the possibility of such loss or damages.

(c) Find a Tearoom does not guarantee continual availability of The Website or the services provided by The Website to Visitors or to Authorized Clients. Find a Tearoom reserves the right to cancel or suspend The Website temporarily or indefinitely at any time, without notice and without any liability whatsoever for any resulting loss.

(10) General Terms and Conditions

(a) Find a Tearoom does NOT warrant that:

(i) the Website will be available at all times. 

(ii) the Website will be error free. 

(iii) the Website will not experience interruptions. 

(iv) the Website and the Web Server on which The Website is hosted is free of viruses, trojan horses, worms, malwale or other components deemed harmful. 

(v) the data stored on The Website is accurate or up-to-date. 

(vi) the data stored on The Website will not be lost.
